Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and The Family Keep, operated by Kristen McCall ("Company," "we," "us," or "our"), governing your access to and use of The Family Keep platform, website, and related services (collectively, the "Service").

You must be at least 18 years of age to create an account and use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Description of Service

The Family Keep is an AI-powered family life design platform that helps families organize, plan, and preserve their family life. The Service includes features such as:

• Butler AI — an AI-powered family steward that processes information and generates briefings
• The Gatehouse — family email management and processing
• Morning Sentinel — daily AI-generated family briefings
• Calendar management and Google Calendar integration
• Family organization tools including tasks, meal planning, and routines
• Family legacy features including Chronicles, The Horizon, and Family Blueprint
• Other features as described on our website and within the app

3. Account Registration and Security

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account at [email protected]
• Be responsible for all activity that occurs under your account

One account may be used per household. You may add family members to your account as permitted by the Service.

4. Subscription and Payment

Subscription Plans

Founding Member Rate: $97/year, available to the first 100 founding members, locked at this rate for the life of the account in good standing. Founding Member accounts include membership in The Keep Collective.

Standard Rate: $27/month, or $269/year (annual plan, two months free), or as otherwise posted on our website.

Billing

• Subscriptions are billed in advance on a recurring basis (monthly or annual, depending on your plan)
• Payment is processed by Stripe and HighLevel/Funnel Gorgeous on our behalf
• You authorize us to charge your payment method on the recurring schedule you select
• All fees are in US dollars and are non-refundable except as described in our refund policy below

The Founding Member Rate Lock

Founding Member accounts maintain their $97/year rate for as long as the account remains active and in good standing. The rate lock applies to the account holder and does not transfer. The rate lock is void if:

• The account is cancelled (you may resubscribe at the then-current rate)
• Payment fails and is not resolved within 30 days
• The account is terminated for violation of these Terms

Refund Policy

We offer a 30-day money-back guarantee on new subscriptions. If The Family Keep isn't right for your family for any reason, contact us at [email protected] within 30 days of account activation for a full refund — no forms, no hoops. After 30 days, all fees are non-refundable except where required by law.

Anthropic API Key (Required for Butler Features)

Butler AI features — including the Morning Sentinel, Gatehouse processing, and AI-generated briefings — require you to connect your own Anthropic API key. This is by design: your family's information is processed through your own Anthropic account, not pooled through ours. You are responsible for obtaining your API key and for usage costs billed directly by Anthropic, which are separate from your Family Keep subscription. Most families' typical usage costs a few dollars per month; The Family Keep is not responsible for Anthropic's pricing or billing. Features that do not rely on Butler AI remain fully available without an API key.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations
• Share your account credentials with individuals outside your household
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to harass, abuse, or harm others
• Introduce viruses, malware, or other harmful code
• Scrape, crawl, or extract data from the Service through automated means
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service to store or transmit illegal content
• Resell or commercialize access to the Service without our written permission

6. Your Content

Ownership

You retain ownership of all content you create, upload, or store within the Service ("Your Content"), including family data, memories, notes, and other information you enter. We do not claim ownership of Your Content.

License to Us

By using the Service, you grant us a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely as necessary to provide the Service to you. We do not use Your Content to train AI models. We do not share Your Content with third parties except as described in our Privacy Policy.

Your Responsibility

You are responsible for Your Content and for ensuring you have the right to upload and store it within the Service. You represent that Your Content does not violate any third-party rights or applicable laws.

7. Google Calendar Integration

When you connect your Google Calendar to the Service:

• You authorize us to view and add or edit events on your Google Calendar on your behalf. We request access to calendar events only — not the ability to delete or manage entire calendars
• We use this access solely to display your calendar within the app and to add events on your behalf
• Our use of Google user data complies with the Google API Services User Data Policy, including the Limited Use requirements
• You may disconnect your Google account at any time by visiting Settings within the app
• We do not share your Google Calendar data with third parties beyond what is necessary to provide the Service

8. Intellectual Property

The Service, including its design, features, functionality, text, graphics, logos, and software, is owned by The Family Keep and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service or its content without our express written permission.

The Family Keep name, logo, shield mark, "Butler," "The Gatehouse," "Morning Sentinel," "The Horizon," "Family Life Design," and related marks are trademarks of The Family Keep. Nothing in these Terms grants you any right to use our trademarks.

9. Third-Party Services

The Service integrates with third-party services including Google, Anthropic, and Stripe. Your use of these integrations is subject to the respective third parties' terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

You agree to indemnify, defend, and hold harmless The Family Keep, its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, Your Content, or your violation of these Terms.

13. Termination

By You

You may cancel your account at any time through the account settings or by emailing [email protected]. Cancellation takes effect at the end of your current billing period. You will retain access to the Service through the end of your paid period.

By Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• We are required to do so by law
• We discontinue the Service
• Your payment fails and is not resolved within 30 days

Upon termination, your right to use the Service ceases immediately. We will provide you with a reasonable opportunity to export your data before permanent deletion, except where termination is due to your violation of these Terms.

14. Data Export and Portability

We believe your family's data belongs to you. Upon request, we will provide you with an export of Your Content in a standard format. To request a data export, contact us at [email protected]. We will fulfill export requests within 30 days.

15. Changes to the Service

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable advance notice of material changes that negatively impact your use of the Service. Founding Members will be given at least 90 days notice of any changes that affect their founding member benefits.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and post a notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved as follows:

• Informal Resolution: Before filing any claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days
• Binding Arbitration: If informal resolution fails, disputes shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules
• Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in a class action lawsuit or class-wide arbitration
• Small Claims: Either party may bring claims in small claims court in Williamson County, Tennessee for disputes within that court's jurisdiction

18. Miscellaneous

• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and The Family Keep regarding the Service
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect
• Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future
• Assignment: You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets
• Force Majeure: We are not liable for delays or failures caused by circumstances beyond our reasonable control
